Red Shield Reserve Inc. was warned for manufacturing and selling e-liquid tobacco products through its website without obtaining required premarket authorization orders, violating the Family Smoking Prevention and Tobacco Control Act and the Federal Food, Drug, and Cosmetic Act. The FDA determined that the e-liquids met the definition of newly deemed tobacco products subject to FDA jurisdiction as of August 8, 2016, and therefore required compliance with premarket review requirements for any tobacco products not commercially marketed in the United States as of February 15, 2007. The company was operating in violation of section 910 of the FD&C Act, which mandates marketing authorization orders before new or modified tobacco products can be legally sold in the United States.
