Wick 'N' Vape, LLC was warned for manufacturing and distributing electronic nicotine delivery system (ENDS) products that were subject to FDA tobacco product regulations but lacked required premarket authorization as "new tobacco products" under the Family Smoking Prevention and Tobacco Control Act. The company failed to comply with section 910(a) of the Federal Food, Drug, and Cosmetic Act, which mandates that new tobacco products (those not commercially marketed in the United States before February 15, 2007, or modified products marketed after that date) obtain FDA premarket approval before distribution. As ENDS products were deemed tobacco products effective August 8, 2016, the company's continued commercial distribution without the required premarket authorization constituted a violation of FDA's tobacco product regulations.
