Sabrina Cosmetics d/b/a SCOS sold electronic nicotine delivery systems (ENDS) products through their website to customers in the United States without proper age verification controls. The company was found to have sold a PUFF Plus Mixed Berries Disposable ENDS product (part of a Mixed Berry Bundle) to an individual under 21 years of age, violating the Family Smoking Prevention and Tobacco Control Act and rendering the product misbranded under federal law. This violation occurred after the March 2022 legislative expansion of FDA tobacco jurisdiction to include all nicotine-containing products from any source, and after the April 2022 implementation of the federal minimum age requirement of 21 for all tobacco product sales.
