New Vaping US sold electronic nicotine delivery systems (ENDS) products through its websites newvaping.us and vapingland.com in violation of federal tobacco product regulations. FDA determined that the company's SWFT Mod Recharge Gummy Bear and Naked – American Patriots ENDS products were misbranded because they were sold to individuals under 21 years of age, violating section 903(a)(7)(B) of the Federal Food, Drug, and Cosmetic Act. This violation occurred after March 2022 legislation expanded FDA's jurisdiction to all nicotine-containing products regardless of source and established a minimum age requirement of 21 for all tobacco product sales.
