Sayar Food Market, Inc., an importer of food and beverages, failed to develop, maintain, and follow required Foreign Supplier Verification Programs (FSVPs) for any of its imported food products, in violation of section 805 of the FD&C Act and 21 CFR part 1 subpart L. During a remote FSVP inspection conducted February 16 through March 8, 2021, the FDA found the company had no FSVPs in place for multiple imported products, despite having received FDA 483a observations citing similar deficiencies during a prior inspection on February 7, 2019, to which the company never responded. This represented a significant compliance failure, as the FSVP regulation requires importers to perform risk-based verification activities to ensure imported foods meet applicable U.S. food safety standards.
