LB Vision Holdings, Inc. d/b/a VaperMate #206, LLC, a manufacturer and distributor of e-liquid tobacco products containing nicotine, was found to be in violation of the Federal Food, Drug, and Cosmetic Act and its implementing regulations under FDA's Center for Tobacco Products jurisdiction. The company's e-liquid products, which fall under the expanded definition of tobacco products (including those containing nicotine from any source following the March 2022 legislative amendment), were not in compliance with FDA requirements for legally marketed tobacco products, which require premarket authorization for new tobacco products. The warning was issued on June 8, 2023, following FDA review of the company's submissions and inspection records.
