Kissy Vape was found offering electronic nicotine delivery system (ENDS) products for sale on its website without required premarket authorization from the FDA, violating the Federal Food, Drug, and Cosmetic Act. The company failed to comply with FDA jurisdiction over tobacco products containing nicotine from any source, a requirement that was expanded in March 2022 to include non-tobacco-derived nicotine. Under section 910 of the FD&C Act, new tobacco products must obtain marketing authorization orders before being legally distributed in the United States, which Kissy Vape had not obtained for the products reviewed on its website.
