The company failed to comply with FDA regulations requiring "new tobacco products" to obtain premarket authorization orders before being legally marketed in the United States, and their products containing nicotine from any source were not in compliance with the Federal Food, Drug, and Cosmetic Act and its implementing regulations. The FDA's inspection of the company's website (flovape.com) identified the unauthorized sale of these tobacco products to U.S. customers.
