Euphoria Fancy Food Inc., an importer of food and beverages, failed to comply with the Foreign Supplier Verification Program (FSVP) regulation required under section 805 of the Federal Food, Drug, and Cosmetic Act. During inspections conducted in July-August 2022 and previously in August 2019, the FDA found that the company had no FSVP records for any foods it imported and could not demonstrate risk-based verification activities to ensure imported foods met U.S. food safety standards. Although the company responded to inspection observations by stating it had hired a consultant and obtained paperwork from suppliers, the response lacked documentation or details required to demonstrate FSVP compliance.
