Cecilia Alvarez, a food importer in McAllen, Texas, failed to develop, maintain, and follow a Foreign Supplier Verification Program (FSVP) for imported foods including potato chips, cookies, and corn chips, in violation of section 805 of the Federal Food, Drug, and Cosmetic Act and 21 CFR part 1, subpart L. During an FDA inspection conducted from July 26-28, 2022, investigators found that the company had not established any FSVP documentation for the foods it imported from foreign suppliers, and the company did not respond to the FDA 483a observations issued at the conclusion of the inspection. This was a repeat violation, as the FDA had also conducted an FSVP inspection of the company in April 2020.
