MadTown Vapor LLC was warned that its e-liquid products sold through its website were subject to FDA jurisdiction as tobacco products under the Family Smoking Prevention and Tobacco Control Act but lacked required premarket authorization orders. The company failed to comply with federal requirements applicable to "new tobacco products," which mandate premarket marketing authorization under section 910 of the Federal Food, Drug, and Cosmetic Act before products can be legally sold in the United States. The FDA's Center for Tobacco Products determined these e-liquids were manufactured and distributed without the necessary regulatory approval required since the August 8, 2016 deeming rule expanded FDA oversight to newly deemed tobacco products including electronic nicotine delivery systems and their liquids.
