Chevaline Investments dba VaporCore, a manufacturer and distributor of e-liquid tobacco products, was found to be manufacturing and offering for sale e-liquids without required premarket authorization as mandated by the Family Smoking Prevention and Tobacco Control Act. The company failed to comply with FDA requirements applicable to deemed tobacco products, which have been subject to FDA regulation since August 8, 2016, including the requirement that "new tobacco products" obtain premarket authorization before commercial distribution. The FDA determined that VaporCore's e-liquid products, derived from tobacco and intended for human consumption, met the definition of regulated tobacco products under the Federal Food, Drug, and Cosmetic Act but were being distributed without the required regulatory authorizations.
