NAFTA Distributors Inc. failed to develop, maintain, and follow a Foreign Supplier Verification Program (FSVP) for multiple imported food products including lollipops, candy specialties, blended vegetable oils, and jams/jellies, in violation of section 805 of the FD&C Act and 21 CFR part 1, subpart L. During an FDA inspection conducted February 7-21, 2023, investigators identified significant compliance gaps in the company's risk-based activities to verify that imported foods met applicable U.S. food safety standards. The company had not responded to the Form FDA 483a Observations issued on February 21, 2023, at the time the warning letter was issued on June 21, 2023.
