Ocalsa Transport & Logistics, LLC, an importer of food and beverages, failed to develop, maintain, and follow a Foreign Supplier Verification Program (FSVP) as required by federal law, specifically for fresh produce imports including onions, peppers, and husk tomatoes. During an inspection in February 2023, the FDA found the company had not implemented any FSVP controls for its imported foods, which violated 21 CFR Part 1 Subpart L and Section 805 of the Federal Food, Drug, and Cosmetic Act. The company did not respond to the FDA's Form 483a observations issued at the conclusion of the inspection.
