JMJ Howard Enterprises, Inc. d/b/a Netvapes was warned for manufacturing and distributing e-liquid tobacco products without the required premarket authorization orders mandated by the Family Smoking Prevention and Tobacco Control Act. The company's e-liquids, which fall under FDA jurisdiction as newly deemed tobacco products as of August 8, 2016, were being offered for sale through their website (netvapes.com) in violation of section 910(a) of the Federal Food, Drug, and Cosmetic Act, which requires "new tobacco products" to obtain FDA premarket authorization before legal marketing in the United States. The FDA's review found that the products lacked the necessary compliance documentation and were therefore considered adulterated and misbranded under applicable tobacco regulations.
