Escape Vape Lounge was warned for manufacturing and distributing e-liquid tobacco products without obtaining required premarket authorization under the Family Smoking Prevention and Tobacco Control Act. As a manufacturer of electronic nicotine delivery systems (deemed tobacco products as of August 8, 2016), the company was required to submit a marketing authorization order for any new tobacco products or modified products commercialized after February 15, 2007, but failed to do so. The FDA determined the company's e-liquid products were being offered for sale and distribution in the United States in violation of section 910 of the Federal Food, Drug, and Cosmetic Act.
