Game Trader, an e-liquid manufacturer and distributor in Brighton, Colorado, was found to be manufacturing and distributing tobacco products without required premarket authorization under the Federal Food, Drug, and Cosmetic Act. The company failed to comply with FDA jurisdiction requirements for e-liquid products containing nicotine, which fall under tobacco product regulations regardless of nicotine source following the March 2022 legislative expansion of FDA authority. As a "new tobacco product" not commercially marketed before February 15, 2007, Game Trader's e-liquid products required premarket approval that was not in effect at the time of inspection.
