VaporIce Inc. was cited for manufacturing and distributing e-liquid tobacco products without required premarket authorization under the Family Smoking Prevention and Tobacco Control Act. The FDA determined that the company's e-liquids, offered for sale on their website, met the definition of newly deemed tobacco products subject to FDA jurisdiction as of August 8, 2016, and therefore required a marketing authorization order under section 910 of the Federal Food, Drug, and Cosmetic Act before legal distribution in the United States. The Center for Tobacco Products identified these violations during a review of the company's website in February 2021.
