Cali Steam, LLC was warned that its e-liquid products sold through its website were deemed tobacco products subject to FDA regulation under the Family Smoking Prevention and Tobacco Control Act but lacked required premarket authorization orders. The company failed to comply with the Federal Food, Drug, and Cosmetic Act requirements that all "new tobacco products" (those not commercially marketed in the U.S. before February 15, 2007) obtain marketing authorization before being legally sold in the United States. The FDA's Center for Tobacco Products identified these violations following a review of the company's website showing e-liquid products being manufactured and offered for sale to U.S. customers.
