Vapor Dynasty LLC manufactured and distributed e-liquid tobacco products without obtaining required premarket authorization, violating the Family Smoking Prevention and Tobacco Control Act. The FDA determined that the company's e-liquid products met the definition of deemed tobacco products subject to FDA jurisdiction since August 8, 2016, and therefore required marketing approval before commercial distribution in the United States. The company failed to comply with section 910 of the Federal Food, Drug, and Cosmetic Act, which mandates premarket authorization for new tobacco products not commercially marketed before February 15, 2007.
