Etomic LLC d/b/a Rogue Liquids was warned for manufacturing and selling e-liquid tobacco products without required premarket authorization under the Family Smoking Prevention and Tobacco Control Act. The company's e-liquids, identified as "new tobacco products" lacking commercial marketing history prior to February 15, 2007, were being distributed through their website in violation of section 910 of the Federal Food, Drug, and Cosmetic Act, which requires premarket authorization orders for legal U.S. marketing. The FDA determined the products were adulterated and misbranded under applicable tobacco product regulations.
