Tropic Trading Co., a food importer based in California, failed to comply with the Foreign Supplier Verification Program (FSVP) regulation for imported fresh produce including durian, longan fruit, and rambutan. The company did not develop, maintain, or follow any FSVP as required by federal law for the foods it imported, and failed to respond to an FDA Form 483a observations list issued during the August 2021 inspection. The violations represented significant non-compliance with section 805 of the Federal Food, Drug, and Cosmetic Act and the implementing FSVP regulation in 21 CFR part 1, subpart L.
