Tuyo Health sold unapproved and misbranded compounded semaglutide and tirzepatide products over the internet, falsely claiming they contained "the same active ingredient" as FDA-approved brand-name medications like Wegovy, Ozempic, Zepbound, and Mounjaro. The company violated the Federal Food, Drug, and Cosmetic Act by making misleading marketing claims that implied their compounded products were equivalent to approved drugs, when compounded products are not FDA-approved. These violations constituted unlawful introduction of misbranded drugs into interstate commerce under sections 502(a) and 502(bb) of the FDCA.
