Las Villas Health Care LLC sold unapproved and misbranded compounded drugs, including semaglutide and sildenafil, directly to consumers via their website in violation of the Federal Food, Drug, and Cosmetic Act. The company made false or misleading claims that their compounded products were equivalent to FDA-approved drugs (Ozempic, Wegovy, and Viagra), when compounded drugs are by definition not FDA-approved. These marketing claims violated sections 502(a) and 502(bb) of the FDCA, which prohibit false or misleading labeling and advertising of compounded drug products, and constituted unlawful introduction of misbranded drugs into interstate commerce.
