Healthon Inc. sold unapproved and misbranded compounded drug products (semaglutide and tirzepatide) over the internet by making false or misleading claims that their products contained "the same active ingredient" as FDA-approved drugs like Wegovy, Ozempic, Mounjaro, and Zepbound, and that they provided "clinically proven weight loss." The company violated the Federal Food, Drug, and Cosmetic Act by implying their compounded formulations were equivalent to approved medications when compounded drugs are not FDA-approved, thereby misbranding the products under sections 502(a) and 502(bb) of the FDCA.
