Rocky Mountain Ecigs, LLC was found to be manufacturing and distributing e-liquid tobacco products through their websites without the required premarket authorization orders mandated by the Family Smoking Prevention and Tobacco Control Act. The company's e-liquid products, which fall under FDA jurisdiction as deemed tobacco products since August 2016, were being offered for sale in violation of section 910 of the Federal Food, Drug, and Cosmetic Act, which requires new tobacco products to obtain marketing authorization before being legally sold in the United States. The FDA determined these products met the definition of tobacco products under section 201(rr) of the FD&C Act and were therefore subject to FDA regulation and compliance requirements.
