Quad Life USA Inc. was warned that its e-liquid products sold on its website were unregistered tobacco products subject to FDA jurisdiction under the Family Smoking Prevention and Tobacco Control Act, including products containing nicotine from any source following the 2022 legislative expansion of FDA's tobacco authority. The company failed to obtain required premarket authorization orders before marketing these "new tobacco products" in the United States, in violation of section 910(a) of the Federal Food, Drug, and Cosmetic Act. The FDA identified these compliance failures during a review of the company's website and its distribution of e-liquid products to U.S. customers.
