Mr Fog Switch was warned for offering electronic nicotine delivery system (ENDS) products for sale through its website without the required premarket authorization from the FDA. The company's products, which contain nicotine and fall under FDA jurisdiction as tobacco products, violated the Federal Food, Drug, and Cosmetic Act by being marketed without an approved marketing authorization order, which is required for any "new tobacco products" not commercially marketed in the United States as of February 15, 2007. The FDA's jurisdiction over these products was further reinforced by 2022 legislation that extended regulatory authority to all products containing nicotine from any source, regardless of origin.
