Exotic Wholesale LLC was cited for selling and distributing e-liquid products containing nicotine without required premarket authorization orders, in violation of the Federal Food, Drug, and Cosmetic Act. The company failed to comply with FDA tobacco product regulations applicable to nicotine-containing products from any source, which have been under FDA jurisdiction since March 2022. As a distributor of these "new tobacco products" that were not commercially marketed before February 15, 2007, the company was required to obtain marketing authorization orders from the FDA before continuing sales in the United States.
