Vapor Authority, Inc. was warned for offering electronic nicotine delivery system (ENDS) products for sale without the required premarket authorization, in violation of the Family Smoking Prevention and Tobacco Control Act. The FDA determined that products listed on the company's website constitute tobacco products subject to FDA jurisdiction because they contain nicotine from any source, and such "new tobacco products" must obtain premarket authorization before being legally marketed in the United States. The inspection of the company's website identified these unapproved ENDS products being offered for distribution to U.S. customers.
