Vapor Rage LLC manufactured and distributed e-liquid tobacco products containing nicotine without the required premarket authorization mandated by the FDA for new tobacco products under the Federal Food, Drug, and Cosmetic Act. The company failed to comply with FDA jurisdiction requirements applicable to nicotine-containing products, which expanded in March 2022 to include products made from non-tobacco nicotine sources. The Center for Tobacco Products determined the products were adulterated and/or misbranded under the FD&C Act and implementing regulations.
