Global Vapery LLC and Infinite Vapor LLC were warned that their e-liquid tobacco products required premarket authorization orders under the Family Smoking Prevention and Tobacco Control Act but were being manufactured and offered for sale without such authorization. The FDA determined these products met the definition of newly deemed tobacco products subject to federal regulation as of August 8, 2016, and were therefore not in compliance with Federal Food, Drug, and Cosmetic Act requirements for legal marketing in the United States. The company had been selling these unapproved tobacco products through their website globalvapery.com to U.S. customers.
