Alohma LLC d/b/a Kure CBD & Vape, located in Lincoln, Nebraska, was cited for manufacturing and distributing e-liquid products containing nicotine that are classified as tobacco products under FDA jurisdiction. The company failed to obtain required premarket authorization orders for these "new tobacco products" before marketing them in the United States, in violation of the Federal Food, Drug, and Cosmetic Act. This violation applied to nicotine-containing products regardless of whether the nicotine was derived from tobacco or other sources, following the March 2022 legislative expansion of FDA tobacco product authority.
