The company's e-liquid products fall under FDA jurisdiction as tobacco products under the expanded definition that includes products containing nicotine from any source (effective March 15, 2022), yet the products were not in compliance with applicable Federal Food, Drug, and Cosmetic Act requirements. As "new tobacco products" not commercially marketed before February 15, 2007, or modified products marketed after that date, these e-liquids were required to obtain a marketing authorization order under section 910(c)(1)(A)(i) of the FD&C Act before legal distribution in the United States.
