LA EJUICE LLC, d/b/a Five Star Juice was cited for selling electronic nicotine delivery system (ENDS) products without obtaining required premarket authorization orders, as mandated under the Federal Food, Drug, and Cosmetic Act for "new tobacco products." The company failed to comply with FDA regulations governing tobacco products containing nicotine from any source, which became subject to FDA jurisdiction following the March 2022 expansion of tobacco product definitions under the Consolidated Appropriations Act. The products were found to be unapproved and therefore adulterated and misbranded under FDA law.
