Xhale Vapor N Smoke was cited for selling and distributing e-liquid products containing nicotine without the required premarket authorization orders mandated by the FDA under the Family Smoking Prevention and Tobacco Control Act. The company's e-liquid products, which fall under FDA jurisdiction as tobacco products under the expanded definition that includes all products containing nicotine from any source (effective March 2022), were found to be marketed illegally without the necessary section 910 premarket approval. The Center for Tobacco Products determined that these products must comply with FD&C Act requirements and cannot be legally marketed in the United States without obtaining a marketing authorization order before distribution.
