The FDA determined that the products listed on the company's website constitute tobacco products subject to FDA jurisdiction because they contain nicotine from any source and are intended for human consumption. The company failed to comply with section 910(a) of the Federal Food, Drug, and Cosmetic Act, which requires "new tobacco products" to have premarket authorization before being legally marketed in the United States.
