Love Your Potion was cited for distributing electronic nicotine delivery system (ENDS) products containing nicotine without obtaining required premarket authorization from the FDA, in violation of the Family Smoking Prevention and Tobacco Control Act. The company offered these tobacco products for sale through its website (yourlovepotion.com) without the necessary marketing authorization order that FDA requires for new tobacco products under section 910 of the Federal Food, Drug, and Cosmetic Act. The violations applied regardless of whether the nicotine was derived from tobacco or other sources, as the FDA's jurisdiction was expanded in March 2022 to cover all products containing nicotine from any source.
