Hookies and Bookies, a manufacturer and distributor of e-liquid tobacco products, was found to be in violation of the Family Smoking Prevention and Tobacco Control Act and Federal Food, Drug, and Cosmetic Act requirements. The company manufactured and offered for sale e-liquid products—which are deemed tobacco products under FDA jurisdiction as of August 8, 2016—without obtaining required premarket authorization for these "new tobacco products" that were not commercially marketed in the United States prior to February 15, 2007. The products were determined to be adulterated and/or misbranded due to non-compliance with FDA tobacco product regulations.
