Wise Guys Vapes was warned for manufacturing and distributing e-liquid tobacco products without obtaining required premarket authorization from the FDA. The company's electronic nicotine delivery system products fell under FDA jurisdiction following the August 8, 2016 deeming rule and were classified as "new tobacco products" requiring marketing authorization orders under the Family Smoking Prevention and Tobacco Control Act. The Center for Tobacco Products determined the products were being offered for sale in the United States in violation of section 910 of the Federal Food, Drug, and Cosmetic Act, which mandates premarket approval for any tobacco products not commercially marketed before February 15, 2007.
