High Voltage Vaporz LLC was warned that its e-liquid tobacco products required premarket authorization orders under the Family Smoking Prevention and Tobacco Control Act but were being manufactured and sold without such approval. The FDA determined that the company's e-liquids met the definition of tobacco products subject to FDA jurisdiction as "new tobacco products" and therefore could not be legally marketed in the United States without premarket authorization. The company failed to comply with section 910 of the Federal Food, Drug, and Cosmetic Act, which requires all new tobacco products to obtain marketing authorization before commercial distribution.
