The company's e-liquids, which meet the FDA definition of tobacco products under section 201(rr) of the FD&C Act, were being sold through their website without compliance with FDA's deeming regulations that became effective August 8, 2016. As "new tobacco products" not commercially marketed before February 15, 2007, these e-liquids required marketing authorization under section 910 of the FD&C Act, which the company had failed to obtain.
