Africana Market LLC, a food importer based in Aurora, Illinois, failed to establish Foreign Supplier Verification Programs (FSVP) for three imported food products: Egusi Seed Paste, Instant Noodles, and Ogbono Nut Meal, in violation of section 805 of the Federal Food, Drug, and Cosmetic Act and 21 CFR part 1 subpart L. During a remote FSVP inspection conducted from February 9 to March 11, 2021, the FDA determined that the company did not develop, maintain, or follow required risk-based verification activities to ensure these imported foods met applicable U.S. food safety standards. The company's submission of a single lab analysis report was insufficient to demonstrate compliance with FSVP requirements. As of the warning letter date, the company had not responded to the Form FDA 483a observations issued at the conclusion of the inspection.
