The company's promotional content claimed the products could boost pregnancy chances, improve IVF success rates, reduce miscarriage risk, and support women undergoing fertility treatment, thereby establishing the products as drugs intended to treat or prevent disease under the Federal Food, Drug, and Cosmetic Act. These products were being sold without FDA approval as new drugs and were misbranded because they lacked required drug labeling and approvals. The FDA and Federal Trade Commission jointly reviewed the company's websites in March and May 2021, respectively, identifying these violations.
