Premium eJuice USA LLC d/b/a Vapor Lab was warned that its e-liquid products sold through myvaporlab.com constitute tobacco products under FDA jurisdiction and were not in compliance with the Family Smoking Prevention and Tobacco Control Act. The company failed to obtain required premarket authorization orders for its "new tobacco products," which have been subject to FDA regulation since August 8, 2016, when e-liquids were deemed tobacco products. The FDA determined the e-liquids were being manufactured and offered for sale or distribution in the United States without the legally mandated premarket review approval.
