Capitol Hill Vapor Co. was cited for manufacturing and distributing e-liquid tobacco products without obtaining required premarket authorization orders as mandated by the Family Smoking Prevention and Tobacco Control Act. The FDA determined that the company's e-liquids, offered for sale on their website, met the definition of newly deemed tobacco products subject to FDA jurisdiction but lacked the legally required marketing authorization under section 910 of the Federal Food, Drug, and Cosmetic Act. The products were found to be in violation of FD&C Act requirements applicable to new tobacco products that were not commercially marketed in the United States prior to February 15, 2007.
