PharmaCanna was cited for marketing CBDefense 2000, a cannabinoid product, as an unapproved new drug intended to mitigate, prevent, treat, diagnose, or cure COVID-19, in violation of section 505(a) of the Federal Food, Drug, and Cosmetic Act. The product was also found to be misbranded under section 502 of the FD&C Act and was being sold through the company's website and social media channels (Facebook and YouTube) without FDA approval or authorization. The FDA and FTC jointly reviewed PharmaCanna's digital marketing materials in November 2022 and January 2023 as part of urgent enforcement efforts during the COVID-19 public health emergency to protect consumers from unapproved products making disease claims.
