OCLO LLC was selling unapproved chlorine dioxide products, including "OCLO 3000," through its website and eCrater storefront with claims they could treat, prevent, or cure COVID-19, violating section 505(a) of the Federal Food, Drug, and Cosmetic Act. The products were also misbranded under section 502 of the FD&C Act, as they lacked required FDA approval and proper labeling. The FDA and Federal Trade Commission jointly reviewed the company's marketing across its website, social media, and online storefronts and determined the sale of these unapproved drugs into interstate commerce violated the FD&C Act during the COVID-19 public health emergency.
