Lux Commercial Group LLC, a food and beverage importer, failed to establish Foreign Supplier Verification Programs (FSVP) for multiple imported products including mango drink, corn chips, and corn flour, in violation of section 805 of the Federal Food, Drug, and Cosmetic Act and 21 CFR part 1 subpart L. During a remote inspection in March 2021, the FDA found the company had no documented FSVPs for any of its imported food products, representing a significant compliance gap in verifying that foreign-supplied foods met applicable U.S. food safety standards. The company had previously received FSVP inspection observations in March 2019 but failed to provide written responses to either the initial or follow-up FDA 483a forms.
