Seafood Brothers Inc., a seafood importer, was cited for serious violations of FDA's seafood HACCP (Hazard Analysis and Critical Control Point) regulations under 21 CFR Part 123 during a March 2023 inspection of its South El Monte, California facility. The company failed to ensure that imported seafood products—including frozen whole cooked white clams from Vietnam, frozen whole clean headless white anchovies from Vietnam, and frozen whole aquaculture tilapia from Taiwan—were processed under conditions equivalent to those required of domestic processors, rendering them adulterated under the Federal Food, Drug, and Cosmetic Act. The violations indicated that the imported products were prepared, packed, or held under insanitary conditions whereby they may have been rendered injurious to health. As an importer, the company was required to provide evidence of HACCP compliance from foreign suppliers but failed to do so, resulting in the products being denied entry into the United States.
